Terms of Service

1. Agreement

These Terms govern your use of the Milkman service ("Service") operated by Milkman Stories Media (Chamber of Commerce 73573566, Jupiterkade 7, 2516BS The Hague, Netherlands). By creating an account or using the Service, you agree to these Terms.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract. If you are using the Service on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms.

3. Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at helpdesk@milkman.digital if you suspect unauthorized access.

4. Use of the Service

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable laws
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service to generate or distribute spam, malware, deceptive, or misleading content
  • Violate the terms of third-party platforms you connect (LinkedIn, Meta, YouTube)
  • Abuse token/credit limits or share credentials with unauthorized parties

5. Content ownership

You retain all rights to the content you upload or generate using the Service ("Your Content"). You grant Milkman a limited license to store, process, and display Your Content solely to provide the Service.

AI-generated drafts are created based on Your Content and are considered Your Content. You are responsible for reviewing and approving content before publishing.

6. Connected social accounts

When you connect a LinkedIn, Meta, or YouTube account, you authorize Milkman to perform actions on your behalf (publishing content, reading metrics) as described in our Privacy Policy. You may disconnect any account at any time. You remain responsible for complying with each platform's terms of service.

7. Plans, billing & tokens

  • Subscription plans are billed monthly or annually via Stripe. Prices are in EUR and exclude VAT where applicable.
  • Token credits reset at the start of each billing cycle. Additional token packs, when purchased, do not expire.
  • You may cancel at any time from the billing portal. Cancellation takes effect at the end of the current billing cycle — no refunds for partial periods.
  • Failed payments may result in account suspension after reasonable notice.

8. 14-day withdrawal right

As a consumer based in the EU, you have a 14-day right of withdrawal when purchasing a subscription. By starting to use the Service immediately after purchase you expressly agree to begin performance, which may waive the withdrawal right for the portion consumed.

9. Availability

We aim for 99.5% uptime but do not guarantee uninterrupted availability. We may perform maintenance, upgrades, or remediation that temporarily affects the Service.

10. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms, with prior notice where reasonably possible. Upon termination, Your Content is deleted within 30 days, except where retention is legally required.

11. Liability

To the maximum extent permitted by law, Milkman's total liability is limited to the amount you paid for the Service in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages including lost profits or data.

Nothing in these Terms excludes liability for gross negligence, willful misconduct, or any liability that cannot be excluded under Dutch law.

12. Changes

We may update these Terms to reflect changes to the Service or legal requirements. Material changes will be communicated via email at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.

13. Governing law

These Terms are governed by Dutch law. Disputes shall be submitted to the competent court in The Hague, Netherlands, unless mandatory consumer law provides otherwise.
